Retention in construction contracts: CPN 3/2022

We have published a new Construction Policy Note highlighting a new chapter we have added to our Client Guide to Construction Projects guidance. This new chapter covers the use of retention in construction contracts.

Improving retention in construction contracts requires all stakeholders in the industry to challenge traditional practices which are largely applied by rote. Retention should be based on systematic, informed and objective processes which attribute defined costs to remediating patently non-compliant delivery.

This guidance is for all public contracting authorities that procure construction projects, whether occasionally or frequently. The new chapter outlines provisions that must be followed from 20 February 2023.
